Terms of Service

1. Introduction

These Terms of Service ("Terms") govern the relationship between Goldland Surveyors Limited ("Goldland Surveyors", "we", "us", "our") and clients who instruct us to carry out surveying or valuation services. By instructing us, you agree to be bound by these Terms.

Goldland Surveyors is a RICS-regulated firm. Our services are provided in accordance with the RICS Rules of Conduct and applicable professional standards.

2. Our Services

We provide residential surveying and valuation services, including but not limited to:

• RICS Home Survey Level 2
• RICS Home Survey Level 3 (Full Structural Survey)
• RICS Valuation Reports (Red Book Valuations)
• Help to Buy Valuations
• Shared Ownership Valuations
• Probate Valuations

The specific scope of each service is set out in our Terms of Engagement provided at the point of instruction.

3. Quotations & Fees

• Quotations are provided free of charge and are valid for 30 days from the date of issue.
• Fees are agreed prior to instruction and confirmed in writing in our Terms of Engagement.
• Payment is required in full before the survey or inspection is carried out, unless otherwise agreed in writing.
• We accept payment by bank transfer or credit/debit card. Details will be provided upon instruction.
• Our fees are inclusive of VAT where applicable.

4. Instruction & Access

• You are responsible for ensuring that we have access to the property at the agreed time.
• If access is denied or the appointment is cancelled with less than 48 hours' notice, we reserve the right to charge a cancellation fee.
• We will only inspect areas that are safely and readily accessible. Hidden, sealed, or dangerous areas will not be inspected.
• Where specialist tests (e.g. electrical, drainage, asbestos) are required, we will recommend engagement of an appropriate specialist.

5. Delivery of Reports

• Reports are typically delivered within 3–5 working days of the inspection, unless otherwise agreed.
• Reports are delivered electronically in PDF format to the email address provided.
• Our reports are prepared for the sole use of the instructing client and must not be relied upon by any third party without our written consent.
• Valuation reports for Help to Buy or Shared Ownership purposes are valid for 3 months from the date of inspection.

6. Limitation of Liability

Our liability to you is limited as follows:

• Our total liability for any claim arising from our services shall not exceed the fee paid for the specific service to which the claim relates, unless required otherwise by law.
• We are not liable for losses arising from matters that were not apparent on a visual inspection, or from areas we were unable to access.
• We maintain professional indemnity insurance in accordance with RICS requirements.
• Nothing in these Terms limits our liability for fraud, personal injury, or death caused by our negligence.

7. Intellectual Property

All reports, documents, and materials produced by us remain our intellectual property. We grant you a non-exclusive licence to use the report for the purpose for which it was commissioned. You must not reproduce, publish, or distribute our reports without written consent.

8. Cancellations & Refunds

• You may cancel your instruction at any time before the inspection without charge, provided you give at least 48 hours' notice.
• Cancellations with less than 48 hours' notice may incur a cancellation fee of up to 50% of the agreed fee.
• Once an inspection has been carried out, the fee is non-refundable.
• If we are unable to complete the service due to circumstances beyond our control, a full refund will be issued.

9. Complaints

If you are dissatisfied with our service, please refer to our Complaints Procedure. We take all complaints seriously and aim to resolve them promptly and fairly.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We reserve the right to update these Terms at any time. The current version will always be available on this page. Continued use of our services after any changes constitutes acceptance of the updated Terms.
